If the status of the patent is "pending", it is pointed out that the manufacturer or property right owner also reserves all rights if the patent is subsequently granted due to the publication and labelling of the relevant products that is taking place here.
All third parties are forbidden from manufacturing, offering, bringing into circulation, using or either importing or owning the product which is the subject of the property right for the above-mentioned purposes without the consent of the owner; from using a process that is the subject of a patent or, if the third party is aware that the use of the process is forbidden without the permission of the patent owner (or this is obvious because of the circumstances), offering it for use within the scope of national laws; from offering, bringing into circulation or using a product that has been directly manufactured using a process that is the subject of a patent or to either importing or owning it for the above-mentioned purposes. End customers and distributors who have purchased the labelled product from the manufacturer may use it for its intended purpose and sell it on, provided that no other legal or contractual provisions apply.
